Terms of use

1 · What these terms cover

These terms govern your use of this website and of the MedicalBytes portals. By using either, you agree to them. If you are using a portal on behalf of an organisation, you confirm you are authorised to accept these terms for that organisation.

Where your organisation has a signed agreement with SeptiBytes Solutions for the MedicalBytes platform, that agreement governs the service and prevails over these terms wherever the two differ. These terms are not a substitute for it.

2 · The website

This website describes the platform. It is not an offer, and the figures and screens on it are illustrative rather than a quotation or a guarantee of performance. Pricing shown is indicative, quoted in United States dollars, and is confirmed in writing before any engagement.

3 · Portal accounts

• Accounts are issued by your organisation's administrator, not by us directly, and the access each account carries is set by the role assigned to it.
• Credentials are personal. Do not share them, and do not let anyone act under your account. Everything done under an account is attributed to the person it belongs to, and the audit trail records it.
• Tell your administrator immediately if you believe an account has been compromised. We will suspend it on request.
• We may suspend an account without notice where we reasonably believe it is being misused or that it puts member data at risk. We tell the organisation when we do.

4 · Acceptable use

You may not use the website or a portal to:

• Access records you have no clinical, administrative or legal need to see.
• Extract data in bulk, scrape, or reverse engineer any part of the platform.
• Submit a claim, authorisation or enrolment you know to be false, or help anyone else to.
• Introduce malicious code, probe the platform's security, or attempt to bypass any access control.
• Build or train a competing product.

Misuse of member health information is not only a breach of these terms. It may be an offence under POPIA and grounds for action by your professional body.

5 · What belongs to whom

The platform, its interfaces, its documentation and the MedicalBytes and SeptiBytes names and marks belong to SeptiBytes Solutions. Nothing here transfers any of that to you; you get the right to use the service for as long as your organisation's agreement runs.

The data stays yours. Member records, claims, rulebooks, tariffs and everything else your organisation loads into the platform remain your organisation's property. We process it on your instruction, we do not use it for any purpose of our own, and on termination it is exported to you in a documented format.

Aggregated, de-identified statistics that cannot identify any person, provider or client may be used to operate and improve the platform.

6 · Confidentiality

Each party keeps the other's confidential information confidential and uses it only for the purposes of the agreement. For us that includes your rulebook, your tariffs, your commercial terms and your member data. The obligation survives the end of the agreement.

7 · Availability and support

We aim for continuous availability and we publish planned maintenance in advance. Specific availability commitments, support hours and response times are set in the agreement with your organisation, not here.

Biometric verification is designed to keep working when connectivity does not. The match runs locally against the stored template, the encounter is recorded, and it synchronises when the connection returns.

8 · What the platform does not do

This matters, so it is stated plainly.

• MedicalBytes does not practise medicine. Clinical decision support presents guidelines, consistency checks and benchmarks. The treating practitioner remains responsible for every clinical decision.
• An authorisation is not a diagnosis or a treatment instruction. It is a statement about cover, under the rules your scheme configured, on the information available at that moment.
• The rulebook is yours. The platform applies the benefit structures, limits, tariffs and approval ceilings your organisation configures. It does not decide what should be covered, and we are not responsible for the consequences of how those rules are set.
• Outputs depend on inputs. Where membership, coding or tariff data loaded into the platform is wrong, decisions made from it will be wrong.

9 · Third-party services

The website uses Google Analytics and Google reCAPTCHA, and links to third-party sites we do not control. We are not responsible for their content or their practices.

10 · Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of goodwill, or loss arising from data your organisation or a provider entered incorrectly. Any liability we do carry for the platform is limited as set out in your organisation's agreement. This website itself is provided as it stands, without warranty.

11 · Suspension and termination

Your right to use this website ends if you breach these terms. Portal access and platform rights run for as long as your organisation's agreement runs and end with it, subject to the export and deletion provisions in that agreement.

12 · Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

13 · Changes

We may update these terms. The effective date at the foot of the page shows when the current version took effect. Material changes affecting a client organisation are notified under that organisation's agreement rather than by a change to this page alone.
